These Terms & Conditions govern your use of petersonequipment.com (the "Site"), which is operated by Peterson Equipment Company ("PEC," "we," "us"). By using the Site, you agree to these terms. If you do not agree, please do not use the Site.

What the Site is for

The Site provides information about PEC, the equipment, parts, and services we offer, and ways to contact us. You cannot buy equipment through the Site. Nothing on the Site is an offer to sell; a sale happens only when we issue a written quote or agreement and both sides sign or accept it.

Equipment listings, specifications, and pricing

• We work to keep listings accurate, but descriptions, photos, hours, specifications, availability, and prices may contain errors or change without notice.
• Equipment may be sold or removed before a listing is updated. Contact us to confirm current availability and price.
• Photos are for illustration. A particular machine may differ in equipment, attachments, condition, or appearance.
• Used and pre-owned equipment is sold as described in the written quote or agreement. Unless that document says otherwise in writing, used equipment is sold "as is," and we encourage a buyer to inspect it before purchase.
• Quotes are valid only for the period stated on the quote, and are subject to credit approval, freight, taxes, and other charges where they apply.

Warranty and service requests

Warranty coverage on new equipment is provided under the manufacturer's written warranty terms. Submitting a warranty claim form on the Site starts a review; it does not guarantee that a repair or part is covered. Service and parts requests submitted online are requests for contact, not confirmed appointments or orders, until we confirm them.

Your use of the Site

You agree not to:

• use the Site for anything unlawful, or in a way that could harm us, other users, or the Site itself
• submit false, misleading, or someone else's information
• attempt to gain unauthorized access to the Site, our systems, or other users' data, or introduce malware
• use bots, scrapers, or automated tools to copy the Site or to send spam through our forms or chat

Information you submit through our forms, chat, or email must be accurate, and you confirm you have the right to provide it.

Intellectual property

The Site's text, layout, graphics, logos, and photographs belong to PEC or are used with permission, and are protected by copyright and trademark law. You may view and print pages for your own business use in dealing with us. Any other copying, republishing, or commercial use requires our written permission.

PistenBully and PowerBully are trademarks of Kässbohrer Geländefahrzeug AG. PEC is an authorized dealer and is not the owner of these marks. Other product names and brands on the Site belong to their respective owners and are used only to identify their products.

Links to other sites

The Site links to third-party websites and includes content from third-party services. We do not control them and are not responsible for their content, policies, or practices. Using them is at your own risk.

Disclaimer

The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Site will be uninterrupted, error-free, or free of harmful components. Nothing on the Site is professional, engineering, or safety advice; always follow the manufacturer's operator manuals and safety instructions for any machine.

Limitation of liability

To the fullest extent the law allows, PEC and its owners, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of, or inability to use, the Site or from reliance on its content. Our total liability for any claim arising from your use of the Site is limited to $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. This section does not limit any rights or remedies under a separate written sales, lease, or service agreement with us.

Indemnity

You agree to defend and hold PEC harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these terms.

Privacy

Our Privacy Policy explains how we handle information collected through the Site and is part of these terms.

Governing law

These terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Any dispute arising from your use of the Site will be brought in the state or federal courts located in Utah, and you consent to their jurisdiction.

Changes to these terms

We may change these terms at any time by posting the updated version here. The effective date above shows the latest revision. Your continued use of the Site after a change means you accept it.
